1. About these terms

These Terms of Service ("Terms") govern your use of top-founders.com ("Service", "we", "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other entity, you confirm you have authority to bind that entity to these Terms.

2. The service

top-founders.com provides competitor-intelligence tooling that transforms historical market signals into roadmap insights, including baseline, differentiation and no-go recommendations.

The Service is for business planning support only. You remain responsible for your decisions, compliance obligations, and any outcomes from implementation.

3. Accounts and access

• You must provide accurate, current account information.
• You are responsible for activity under your account and workspace.
• Do not share access credentials or bypass security controls, seat controls, or usage limits.
• We may suspend or restrict access to protect the Service, investigate abuse, or meet legal requirements.

4. Plans, billing and renewal

Free, Pro and Enterprise access are offered under plan-specific limits and capabilities. Paid plans are billed through Stripe on a recurring basis unless otherwise agreed in a written Enterprise order.

• Subscriptions renew automatically each billing period until you cancel.
• You can cancel at any time from your in-app billing settings. Cancellation takes effect immediately and stops future renewals.
• No refunds. All fees are non-refundable and are charged in full at the start of each billing period. We do not provide refunds or credits for partial periods, unused time, downgrades, seats not used, or after a cancellation. Refunds, if any, are granted solely at our discretion on a case-by-case basis and are not an entitlement. This applies to the maximum extent permitted by law.
• Advance renewal notice. Before each renewal we send an email reminder to the address on file (at least 72 hours in advance where supported by our payment processor) stating the amount and the date your card will be charged. It is your responsibility to keep your email address current and to cancel before renewal if you do not wish to be charged.
• Authorization & consent. By starting a subscription you authorize us and our payment processor (Stripe) to charge your payment method on a recurring basis. To operate the Service and to prevent and dispute fraudulent chargebacks, we record and retain evidence of your acceptance of these Terms and your purchase, including timestamps, the Terms version accepted, your email, and the IP address used at acceptance and at purchase.
• Chargebacks. Because cancellation is available instantly in-app and fees are non-refundable, initiating a chargeback or payment dispute instead of cancelling is a breach of these Terms. We may contest such disputes using the consent and usage records described above and may suspend the account pending resolution.
• We may update prices or plan packaging with reasonable prior notice before renewal.

5. Acceptable use

You agree not to:

• use the Service for unlawful, fraudulent, or infringing activity;
• attempt to reverse engineer, scrape, or disrupt the Service infrastructure;
• upload malicious code, spam, or content you do not have rights to use;
• misrepresent Service output as guaranteed legal, financial, or professional advice.

6. Customer data and content

You retain rights in the data and content you submit (for example URL lists, workspace inputs, and messages). You grant us a limited license to host, process and transmit that data as needed to operate, secure and improve the Service.

You represent that you have the necessary rights to submit the data you provide.

Free reports as public case studies. Reports generated on the Free plan (including partial roadmaps produced from publicly available, archived competitor pages) may be published by us as public, non-confidential case studies and examples — for instance under /reports — to demonstrate the Service. These reports are derived from public web-archive history and do not include your account or billing details. You may request removal of a specific published free report at any time by contacting us, and we will unpublish it promptly. Paid-plan (Pro/Enterprise) reports and any private workspace inputs are never published without your explicit consent.

7. Intellectual property

The Service, software, interface, branding, and documentation are owned by us or our licensors and protected by intellectual-property laws. These Terms do not transfer ownership rights to you.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted availability, error-free operation, or that any insight or recommendation will produce a specific business outcome.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, or data.

Our aggregate liability arising out of or related to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for material breach, abuse, non-payment, security risk, or legal requirements.

Sections intended to survive termination (including payment obligations, IP, disclaimers, and liability limits) remain in effect.

11. Changes to terms

We may update these Terms from time to time. Material updates will be posted on this page with an updated date. Continued use after changes become effective means you accept the revised Terms.
